Terms and Conditions of Service
These Terms and Conditions ("Terms") apply to all services provided by Transcend Logistics Co., located in Kingston, Jamaica. By engaging in our shipping, transportation, or logistics services, you ("Customer") agree to these Terms. Please read them carefully before proceeding with any transactions.
1. Definitions
"Company" refers to Transcend Logistics Co.
"Customer" refers to the individual or entity using Transcend Logistics Co.'s services.
"Goods" refers to any items, products, or materials that are the subject of transportation or storage services provided by the Company.
2. Scope of Services
Transcend Logistics Co. provides logistics, transportation, and related shipping services, including but not limited to:
Inland and international cargo shipping.
Freight forwarding.
Storage and warehousing.
Delivery and pick-up services.
Personal Shopping, In-house Shopping and Packing.
The Company will make reasonable efforts to ensure that all services are carried out in a timely and efficient manner, as per the Customer's specifications, unless circumstances beyond its control (force majeure) arise.
3. Liabilities and Limitations
3.1 Limited Liability
Transcend Logistics Co. is committed to providing reliable services. However, the Company’s liability for any claims arising from the handling, storage, and transportation of Goods is limited as follows:
Loss or Damage: The Company’s liability for loss or damage to Goods is limited to the actual value of the Goods or JMD 50,000 per shipment, whichever is lower, unless additional insurance coverage is purchased.
Delays: The Company will not be liable for any delay in shipping or delivery caused by factors outside its control, including but not limited to natural disasters, strikes, or regulatory issues.
Misdelivery: Transcend Logistics Co. will not be liable for misdelivery caused by incorrect or incomplete delivery instructions provided by the Customer.
Exclusion of Certain Items: The Company is not liable for the loss or damage of prohibited items, including but not limited to hazardous materials, perishable goods, valuable items (jewelry, cash), or items not properly packed by the Customer.
3.2. Force Majeure
Transcend Logistics Co. will not be liable for failure to perform or delays due to causes beyond its reasonable control, including but not limited to acts of God, wars, civil unrest, embargoes, governmental restrictions, labor disputes, or natural disasters.
4. Insurance
While Transcend Logistics Co. takes utmost care to handle Goods, the Company recommends that Customers purchase additional insurance coverage for high-value or sensitive shipments. Insurance must be arranged prior to shipping and the cost will be borne by the Customer.
5. Customer Obligations
5.1 Accuracy of Information
The Customer agrees to provide accurate and complete information for shipping, including but not limited to:
A full description of the Goods.
Correct shipping addresses and contact information.
Proper packaging as per industry standards.
5.2 Prohibited Items
The Customer is prohibited from shipping certain restricted items, including but not limited to:
Hazardous or illegal materials.
Items that are subject to regulatory restrictions.
Perishable items unless prior arrangements are made.
Failure to disclose prohibited items may result in immediate termination of the service agreement, and the Customer will bear full responsibility for any fines, penalties, or damages resulting from such non-disclosure.
6. Claims and Complaints
6.1 Reporting
In the event of any loss or damage, the Customer must notify Transcend Logistics Co. in writing within 7 business days from the date of delivery, or in the case of non-delivery, from the expected date of delivery.
6.2 Investigation and Settlement
The Company will investigate claims and, if found valid, will settle the claim based on the declared value of the Goods or the limit of liability as stated above. Claims not reported within the specified timeframe will not be entertained.
7. Payment Terms
7.1 Fees and Charges
All charges for shipping, transportation, storage, and other services are set out in the invoice provided to the Customer. Payments must be made in full within 14 days from the date of the invoice unless otherwise agreed in writing.
7.2 Late Payments
Any payments not received within the stated period may incur late fees of 1.5% per month until the full payment is made.
8. Indemnity
The Customer agrees to indemnify and hold harmless Transcend Logistics Co. from any liability, damage, or cost arising from:
The shipment of prohibited or improperly packed items.
Failure to comply with applicable customs, import/export regulations.
Any breach of these Terms by the Customer.
9. Termination
The Company reserves the right to terminate or suspend services for any Customer that fails to comply with these Terms or engages in illegal activities, without prior notice.
10. Dispute Resolution
In the event of any dispute arising out of or in connection with these Terms, the parties shall first attempt to resolve the dispute through mutual discussions. If the dispute cannot be resolved, the parties agree to submit to the jurisdiction of the courts of Jamaica for resolution.
11. Governing Law
These Terms and Conditions shall be governed by, and construed in accordance with, the laws of Jamaica.
12. Amendments
Transcend Logistics Co. reserves the right to update or modify these Terms at any time without prior notice. Any such changes will be posted on the Company’s website and will apply to all future transactions.

Transcend Logistics Co. - Return Policy
At Transcend Logistics Co., we work hard to provide excellent shipping services. If something goes wrong with your shipment or service, here’s how we handle returns and refunds.
1. Service Issues
If your shipment is delayed, lost, or damaged due to our mistake, you may be eligible for a refund or compensation:
Lost or Damaged Goods: If your items are lost or damaged and you didn't buy extra insurance, we can compensate you up to JMD 50,000 or the value of your items, whichever is lower. If you have insurance, your claim will follow the insurance terms.
Service Delays: If your shipment is delayed due to something we caused, we may offer a refund or credit. Delays caused by things like weather, customs, or strikes don’t qualify.
2. How to Request a Refund or Compensation
If you want to request a refund or compensation, follow these steps:
Report the Problem: Let us know within 7 business days of the delivery date (or the expected delivery date if your items weren’t delivered).

Claim Process: We’ll investigate and get back to you within 14 business days. If your claim is approved, we will either:

3. Returning Stored Items
If we’re holding or storing items for you and you want them returned:
Request Your Items: Contact us to arrange for delivery or pick-up. Any costs for this will be your responsibility.
Wrong Delivery: If we deliver to the wrong place, we’ll fix it at no cost to you.
4. Situations Not Covered
We cannot offer refunds or compensation in certain situations, such as:
Natural Disasters: Events beyond our control, like storms or political issues.
Prohibited Items: If you shipped illegal or improperly declared items.
5. Governing Law
This policy follows Jamaican law and is part of our overall Terms and Conditions.
